1862 British Affidavit and Indenture Preceding the 1870 Married Women's Property Act, Recording the Sale of Land From a Married Couple to a Woman

Affidavit and indenture totaling 2 pages from 28 July 1862 for Katurnah and Benjamin Senior's sale of land to a woman - Elizabeth Robinson. Affidavit measures 13.25" x 9" inches. Indenture measures 14.5" x 9.5" inches. This is the second record in our possession of a sale to Elizabeth Robinson, who had previously purchased land from another woman and her husband in 1858. Robinson was likely exempt from the Law of Coverture and allowed property ownership as an orphan or widow. This document precedes the 1870 Married Women's Property Act. It reveals that rural communities throughout England were increasingly realizing women's involvement with the land and were securing women's legal approvals when their husbands bought or sold land on behalf of the family. Both documents have fold lines but overall in very good condition.
